Hong Kong Land Law is much different to the land law in the United Kingdom and the common law systems. Instead of gaining priority by registering one’s title to the property with the authority, the authority in Hong Kong registers the documents related to the property, e.g. sale and purchase agreement (SPA) and assignment document. Priority is decided mostly by the date on which a title document is registered against the property. Because of the difference in land registration system, please have a focus in formality, i.e. lease agreement, deed of mutual covenant, etc., and attention paid also to adverse possession, government lease and local legislations at the time studying for the subject.
