Everyone today is using mobile phone. It has become an indispensable device in our life. But do we really know the law of mobile? I think we should. Because ignorance to law is no excuse.
In India we have following Acts which cover all sort of mobile and
tele-communication related legal issues. Though the origin of one of the Acts date back to as long old as 1885, but there has been lot of critical amendments which have made them well-equipped with present-world situation. The following are the Acts which cover the legal aspect of mobile and telecommunication related legal issues in India.
Indian Telegraph Act,1885.
The Indian Wireless Telegraphy Act, 1933.
Telecom Regulatory Authority of India Act,1997.
Information Technology Act,2000.
Various Rules.
The definitions provided in section 2 (1)(i), section 2 (ha) and Section 2 (1)(j) of IT Act, under heading “Computer”, “Communication Device” and “Computer Network” have made the point clear that the legal status of mobile phones and Smart Phone devices are the same in Indian legal scenario like that of a computer. Even the IT Act defines "Communication Device" which means Cell Phones, Personal Digital Assistance (Sic), or combination of both or any other device used to communicate, send or transmit any text, video, audio, or image. It is pertinent to note that section 2(1)(j) uses the phrase “other communication media”.
Majority of Indian people are going internet through mobile phone or like devises and mobile has made the information technology and telecommunication technology converged into one. Lot of explorations are taking place in techno-legal aspect as well as new interpretations are coming to appreciate electronic evidence in Court room, forensic field and day to day life of a common people like us.
