the application of the Criminal Code or the Code of Criminal Law.
The Criminal Code or the Code of Criminal Law is the legislation governing the criminal act materially in Indonesia. Criminal Code presently applied is the Criminal Code that comes from the Dutch colonial law, namely Wetboek van Strafrecht voor Nederlandsch-Indie. Ratification is done through the Government Gazette number 732 1915 and enter into force from 1 January 1918. After independence, the Criminal Code shall apply with the alignment of the conditions of revocation of provisions that are no longer relevant. It is based on the Transitional Provisions of Article II of the 1945 Constitution which states that: "All state agencies and regulations that they directly apply for a new one has not been held in accordance with this Constitution." Provision is exactly what later became the legal basis for the implementation of all legislation in the colonial period at the time of independence.
