Considering:

a. that internal security is a major requirement to support the realization

civil society that is fair, prosperous, and civilized based on Pancasila and

Constitution of the Republic of Indonesia Year 1945;

b. that the maintenance of security in the country through the efforts of the discharge

police which includes the maintenance of public order and safety,

law enforcement, protection, and service to the community

conducted by the Indonesian National Police as the national tool

assisted by the society by upholding human rights;

c. that there has been a paradigm shift in the constitutional system

confirms the institutional separation of the Indonesian National Army and Police

The Republic of Indonesia in accordance with the roles and functions of each;

d. that Act No. 28 of 1997 on the Police

Indonesia is inadequate and needs to be replaced to conform with

growth and development as well as the constitutional law of the Republic of Indonesia;

e. referred to in paragraph a, b, c, and d, is necessary to establish the Law

of the Indonesian National Police;

Given:

1. Article 5 paragraph (1), Article 20, and Article 30 of the Constitution of the Republic

Indonesia 1945;

2. People's Consultative Assembly Decree No. VI / MPR / 2000 on

Separation of the Indonesian National Army and the Indonesian National Police;

3. People's Consultative Assembly Decree No. VII / MPR / 2000 on the role of

Indonesian National Army and the role of the Indonesian National Police;

4. Law No. 8 of 1974 on the Fundamentals of Civil

as amended by Act No. 43 of 1999 (Gazette

1999 No. 169, Supplement to Statute Book No. 3890);
